Terms of Service
These Terms of Service ("Terms") govern your use of the Prospect Athlete mobile application and any related services (the "App") operated by Ranch Sports Digital LLC ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms.
1. About the App
Prospect Athlete is an informational tool that helps student-athletes and their families navigate the college sports recruiting process. The App provides recruiting timelines, school matching, athlete profile tools, benchmarking data, and coach outreach organization features.
Prospect Athlete is not a recruiting agency, certified athletic advisor, or licensed educational consultant. The App does not represent athletes, negotiate with coaches or schools, or guarantee any athletic or academic outcome. All content is provided for informational purposes only.
2. Eligibility & Account
You must be at least 13 years old to use the App. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at RanchSportsDigital@gmail.com if you believe your account has been compromised. You may only create one account per person. Accounts are non-transferable.
3. Subscription & Payment
3.1 Free Tier
The App offers a free tier that includes access to the recruiting timeline, basic program search, and a preview of school match results.
3.2 Paid Subscription
A paid subscription unlocks the full school match list, coach outreach tools, verified athlete profile features, showcase recommendations, and the social media playbook.
3.3 Billing
Subscriptions are billed monthly or annually through the Apple App Store and automatically renew unless cancelled at least 24 hours before the end of the current billing period. Manage or cancel through your Apple ID account settings.
3.4 Refunds
All refund requests are handled by Apple. To request a refund, visit reportaproblem.apple.com. We do not process refunds directly.
4. Acceptable Use
By using the App, you agree not to:
- Use the App for any unlawful purpose
- Use coach contact information for any purpose other than legitimate personal athletic recruiting outreach
- Send bulk, unsolicited, or commercial emails to coaches using contact information from the App
- Impersonate another person or misrepresent your identity or athletic credentials
- Attempt to access, scrape, or copy any portion of the App's data by automated means
- Reverse engineer or attempt to extract the App's source code
- Share your account credentials or allow others to access the App through your account
5. Your Content & Data
You retain ownership of the profile data, metrics, and notes you enter into the App. By entering this information, you grant us a limited license to store and display it to you within the App for the purpose of providing our services. You are responsible for the accuracy of the information you enter.
6. Information Accuracy & Disclaimers
6.1 Recruiting Information
Recruiting timeline content, NCAA/NAIA/NJCAA rule summaries, and division benchmarks are based on publicly available information and are intended as general guidance only. Governing body rules change frequently. Always verify current rules directly with the relevant organization (NCAA.org, NAIA.org, NJCAA.org) before making decisions.
6.2 School Matches & Projections
School match results, athletic fit scores, academic fit scores, and division projections are algorithmic estimates. They are not predictions, guarantees, or endorsements. Actual recruiting outcomes depend on many factors outside the App's analysis.
6.3 Cost & Scholarship Estimates
Estimated annual costs and scholarship amounts are based on publicly reported figures and general formulas. Always confirm financial information directly with each school's financial aid and athletics offices.
6.4 Roster & Coach Data
Roster information is based on periodic data scrapes and may not reflect the most current roster activity or transfer portal changes. Coach contact information is sourced from public athletic department websites and may become outdated.
7. Third-Party Links & Services
The App contains links to third-party websites and services, including Baseline Sports (affiliate partner), PBR, Perfect Game, GameChanger, and others. We do not endorse, control, or take responsibility for the content, privacy practices, or reliability of third-party sites.
8. Intellectual Property
The App, including its design, code, content, benchmarks, and original text, is the property of Ranch Sports Digital LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any portion of the App without our written permission.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RANCH SPORTS DIGITAL LLC AND ITS OWNERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
10. Indemnification
You agree to indemnify and hold harmless Ranch Sports Digital LLC and its owners, officers, and agents from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.
11. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute arising from these Terms shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration in Pima County, Arizona, under the rules of the American Arbitration Association.
